TARIFF AND COST REFUND POLICY

Version 1 from April 7th, 2021.

1. This Tariff and Refund Policy is an integral part of the ELECTRONIC SERVICES PROVISION REGULATIONS of TimeTo Sp. z o.o. (published on the website https://lenily.com/le/terms-of-service-le; hereinafter referred to as: Regulations), it defines and establishes all prices (costs) and refund policy based on the Agreement between the Operator and the User.
2. The owner of the lenily.com website is TimeTo Sp. z o.o. based in Gliwice at Dunikowskiego 10, 44-100, registered in the Entrepreneur Register of the National Judicial Register kept by the Gliwice District Court, 10th Commercial Division of the National Judicial Register under number 0000673031, NIP 6312669532 company, HAVING SHARE CAPITAL: 5 000,00 PLN PAID IN FULL, [hereinafter referred to as: Service Provider, Operator], which can also be contacted by e-mail at: info@lenily.com
3. Services provided by the Operator are paid and available on a renewable subscription basis. The service period is 11 calendar days starting from the day of payment for the Services. After this time, the period is automatically extended for another 11 days. The contract is concluded for an indefinite period of time.
4. Operator Services will be provided on a subscription basis starting from the first day of the Subscription Period
5. The subscription will start on the first day of payment and will last until the termination of the agreement (cancellation of the subscription by the User).
6. The user may terminate the Agreement (cancel the subscription) at any time. The procedure for terminating the Agreement is specified in §6 of the Regulations. Such termination will result in the loss of all access to the Service and services provided by the Operator without refunding the costs to the User. To cancel the subscription, the User will go to the "Unsubscribe" page (https://lenily.com/le/unsubscribe) on the Operator's website and follow the instructions for termination (cancellation).
7. Payment, including registration of a payment or credit card and online payments, is handled by the Payment Operator.
8. By making a payment for the service, the user accepts the Payment Operator's Regulations. Payment is not a part of the services provided by the Operator, but it is a service provided by the Payment Operator.
9. By accepting the tariff and return policy of TimeTo Sp. z o.o. and agreeing to the Subscription, the user consents to the periodic collection by the Payment Operator from the payment card of the monetary amount corresponding to the amount of the fee for access to the service. The fee will be collected by the Payment Operator in accordance with §3 of the Tariff and Refund Policy.
10. The user clearly agrees that the moment of commencing the Operator's service is associated with the effective connection of a credit/debit card or making a payment via electronic transfer. The user clearly accepts and acknowledges that the full provision of the service by the Operator (for which a fee is due) occurs after the user has gained access to the fully functional website and has been provided with a list of offers through the website and sent a list of offers to the user's email address provided during registration.
11. The user acknowledges and accepts that the Operator is entitled to remuneration for the service provided. In the event of the need to refund funds for a transaction made by the customer with a payment card, the sellers will make a refund to the bank account assigned to the Ordering party's payment card. The user will not receive a refund for the subscription period in which the service was performed.
12. The price of the operator's services is as follows:
    • Activation fee: 0.00 EUR or 0.01 EUR (the amount of the activation fee depends on the payment service provider and is independent of the Operator)
    • Subscription fee: 6 EUR charged every 11 days
13. Payments for Services under this Agreement will be made based on 100% prepayment in the manner specified in the Regulations and this Payment Policy. Available payment methods: Debit/Credit Cards:
    1. Visa
    2. Visa Electron
    3. Mastercard
    4. MasterCard Electronic
    5. Maestro
14. The user is solely responsible for the correctness of the payment. If the payment is not successfully settled due to expiration, insufficient funds, or for any other reason, and the User does not terminate the Agreement, the Operator immediately blocks the User's account and access to the Service until full payment is made.
15. The User's obligation to pay for the Operator's Services is considered fulfilled only after the full amount of funds has been received into the Operator's account.
16. The operator reserves the right to change the prices (costs) of the Services at its own discretion. In the event of a price change, the Operator informs the User of this fact. If the User does not agree to the price change, they may terminate the Agreement on the terms described in §6 of the Regulations.
17. All prices for Operator's Services will be determined in EUR currency. Operator's Payment Services are non-refundable and do not include bank and/or commercial fees.

Prices of Operator's Services include VAT (15%).
